Terms of Use

1. Acceptance of Terms

By accessing or using PinealOS (the "Platform"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree, you must not use the Platform. These Terms constitute a binding legal agreement between you ("User" or "you") and PinealOS ("we", "us", "our").

2. Service Description

PinealOS is an AI-powered software development platform that enables users to plan, generate, and deploy websites and software through conversational AI interfaces. The Platform provides:

• AI-assisted code generation, editing, and debugging
• Domain search and registration
• Cloudflare Pages deployment
• GitHub repository integration
• Project management and file editing

The Platform operates on a Bring Your Own Key (BYOK) model for AI services. You provide your own API keys for third-party AI providers, and your usage of those services is governed by their respective terms.

3. AI-Generated Content

3.1 Nature of AI Output

AI-generated code and content are produced by third-party AI models (including but not limited to DeepSeek, OpenAI, Anthropic, Google) based on your prompts. AI-generated output may contain errors, vulnerabilities, or inaccuracies. You are solely responsible for reviewing, testing, and validating all AI-generated code before deploying, publishing, or using it in any production environment.

3.2 Ownership of AI Output

To the fullest extent permitted by applicable law, you own the code and content generated by the Platform using your prompts. You are responsible for ensuring that your prompts and the resulting output do not infringe the intellectual property rights of any third party. We make no representations or warranties regarding the originality or copyrightability of AI-generated content.

3.3 Human Review Required

You acknowledge that AI-generated code may not meet industry standards, may contain security vulnerabilities (including but not limited to injection flaws, authentication bypasses, or data exposure), and may be subject to AI hallucination (generating plausible but incorrect code). You must review and test all AI-generated code before use. We strongly recommend automated security scanning and peer review of any AI-generated code deployed to production.

3.4 EU AI Act Compliance

PinealOS acts as an intermediary between you and general-purpose AI models. As a downstream provider under the EU AI Act, we provide the following transparency information: (a) the AI model used to generate output is identified in the chat interface; (b) you are encouraged to document which AI model was used for each generation; and (c) AI-generated output is clearly indicated in the Platform interface. You are responsible for maintaining records of AI-generated code if required by applicable regulations.

4. Disclaimer of Warranties

THE PLATFORM AND ALL AI-GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE AI-GENERATED CODE WILL BE ERROR-FREE, SECURE, OR FUNCTION AS INTENDED.

We do not warrant that:

• The Platform will meet your specific requirements
• AI-generated code will be suitable for any particular purpose
• The Platform will be uninterrupted, timely, secure, or error-free
• The results obtained from the Platform will be accurate or reliable
• Errors or vulnerabilities in AI-generated code will be corrected

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINEALOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, or goodwill
• Service interruption or computer damage
• Cost of procurement of substitute services
• Damages arising from the use of AI-generated code, including security vulnerabilities, data breaches, copyright infringement claims, or any other harm caused by code generated through the Platform

Our total liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount paid by you to us in the twelve (12) months preceding the event giving rise to the liability.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

6. Indemnification

You agree to indemnify, defend, and hold harmless PinealOS, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform, including AI-generated code
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content or code you generate, deploy, or publish using the Platform
• Your violation of any applicable laws or regulations

7. User Accounts and Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must not share your AI API keys with third parties.
• You must not use the Platform for any illegal or unauthorized purpose.

8. Subscriptions, Payments, and Refunds

• Subscription fees are charged at the beginning of each billing period.
• Payments are processed securely by Lemon Squeezy. We do not store payment card information.
• Refund policies are detailed in our separate Refund Policy, which is incorporated by reference.
• We reserve the right to change our pricing with 30 days' notice.
• Failure to pay may result in suspension or termination of your account.

9. Acceptable Use

You agree not to:

• Use the Platform to generate malicious code, malware, or content that violates applicable laws.
• Attempt to circumvent any rate limits, security measures, or access controls.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Use the Platform in any manner that could damage, disable, or impair our infrastructure.
• Generate content that infringes the intellectual property rights of any third party.
• Use automated scripts or bots to interact with the Platform without express authorization.

10. DMCA Copyright Infringement Notice

PinealOS respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to notices of alleged copyright infringement.

10.1 Filing a DMCA Notice

If you believe that content available through the Platform infringes your copyright, please provide our Designated Agent with a written notice containing the following information:

1. Your physical or electronic signature.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing, with sufficient detail to enable us to locate it.
4. Your name, address, telephone number, and email address.
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner.
6. A statement that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

10.3 Counter-Notice

If you believe that material you posted was removed in error, you may submit a counter-notice to our Designated Agent. The counter-notice must include your signature, identification of the material, a statement under penalty of perjury that you have a good faith belief the material was removed in error, and your contact information.

10.4 Repeat Infringers

We maintain a policy of terminating the accounts of repeat infringers in appropriate circumstances.

11. Copyright and License

The PinealOS Platform, including its user interface, design, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for your personal or internal business purposes.

12. Data Processing Agreement (DPA)

The terms of our Data Processing Agreement (DPA) are incorporated into these Terms by reference. The DPA governs the processing of personal data by PinealOS on behalf of our users who act as data controllers. The DPA is available upon request at info@pinealos.com and is deemed accepted when you create an account.

Our sub-processors are listed in the Privacy Policy. You will be notified of any changes to sub-processors and may object within 14 days.

13. Termination

• You may terminate your account at any time by contacting info@pinealos.com.
• We may suspend or terminate your account for violation of these Terms, illegal activity, or non-payment.
• Upon termination, your right to use the Platform ceases immediately. Your data will be deleted within 30 days, subject to legal retention requirements.
• Provisions regarding limitation of liability, indemnification, and intellectual property shall survive termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any dispute arising out of or relating to these Terms shall be resolved through the following process:

1. Negotiation: Parties shall attempt to resolve disputes informally by contacting info@pinealos.com.
2. Jurisdiction: If a dispute cannot be resolved informally, the courts of Istanbul, Turkey shall have exclusive jurisdiction.

For users in the European Union, nothing in these Terms affects your right to rely on mandatory consumer protection laws in your country of residence.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform.
